Terms of Service

1. Agreement to Terms
By accessing or using the Cascadence platform, website, browser extension, APIs, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
"Cascadence", "we", "us", and "our" refer to Cascadence and its operators. "You" and "your" refer to the individual or entity accessing the Service.
2. Description of Service
Cascadence is an outcome monitoring platform that checks whether important flows in your web application produce correct results. The Service includes a Chrome browser extension for recording flows, a web dashboard for reviewing results, and automated replay and anomaly detection capabilities.
The Service is provided on an "as is" and "as available" basis. We may modify, suspend, or discontinue any part of the Service at any time without prior notice.
3. Eligibility
You must be at least 16 years old to use the Service. By using the Service, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
4. Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately at hello@cascadence.io if you become aware of any unauthorised use of your account.
You are solely responsible for the test accounts, credentials, and access you provide to the Service. Cascadence is not responsible for any consequences arising from the credentials or access levels you configure.
5. Acceptable Use
You agree not to:
- Use the Service to monitor applications or systems you do not own or have authorisation to test
- Attempt to gain unauthorised access to our systems or other users' data
- Use the Service to store, transmit, or process data in violation of any applicable law
- Reverse engineer, decompile, or disassemble any part of the Service
- Use the Service to conduct load testing, stress testing, or denial-of-service attacks against any system
- Resell, sublicence, or redistribute the Service without our prior written consent
- Circumvent any usage limits, rate limits, or access controls
6. Your Data
You retain all rights to the data you provide to or generate through the Service ("Your Data"). You grant Cascadence a limited, non-exclusive licence to use Your Data solely to provide and improve the Service.
You are solely responsible for the accuracy, legality, and appropriateness of Your Data. You represent and warrant that you have all necessary rights and permissions to provide Your Data to the Service and that doing so does not violate any third-party rights or applicable laws.
Our handling of personal data is described in our Privacy Policy, which forms part of these Terms.
7. AI-Powered Analysis
The Service uses artificial intelligence and machine learning to analyse your application flows and detect anomalies. You acknowledge and agree that:
- AI-generated results are informational only and may contain errors, false positives, or false negatives
- The Service does not guarantee detection of all bugs, errors, or anomalies in your application
- You are solely responsible for verifying any findings and deciding what action to take
- AI analysis may be performed by third-party providers (such as OpenAI and Anthropic) under their enterprise data processing agreements
- The Service is not a substitute for professional quality assurance, testing, or security auditing
8. Intellectual Property
The Service, including all software, algorithms, designs, text, graphics, and other content provided by Cascadence, is owned by Cascadence and protected by intellectual property laws. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service in accordance with these Terms.
9. Fees and Payment
Certain features of the Service may require payment. Fees are described on our pricing page and may change at any time with 30 days' notice. All fees are non-refundable unless otherwise stated. If you fail to pay any fees when due, we may suspend or terminate your access to the Service.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CASCADENCE DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
Without limiting the foregoing, Cascadence does not warrant that:
- The Service will be uninterrupted, error-free, secure, or available at any particular time or location
- Any defects or errors will be corrected
- The Service will detect all bugs, anomalies, or incorrect outcomes in your application
- The results, analysis, or recommendations provided by the Service will be accurate, complete, or reliable
- The Service will meet your specific requirements or expectations
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CASCADENCE, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, GOODWILL, DATA, BUSINESS OPPORTUNITIES, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:
- Your use of or inability to use the Service
- Any bugs, anomalies, or incorrect outcomes in your application that the Service failed to detect
- Any action taken or not taken based on the Service's analysis, alerts, or recommendations
- Unauthorised access to or alteration of your data or transmissions
- Any third-party conduct or content on the Service
- Any loss or damage arising from your reliance on the Service
- Any interruption, suspension, or termination of the Service
IN NO EVENT SHALL CASCADENCE'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO CASCADENCE IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED POUNDS STERLING (£100).
THIS LIMITATION OF LIABILITY APPLIES REGARDLESS OF THE LEGAL THEORY ON WHICH THE CLAIM IS BASED, INCLUDING CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER THEORY, AND WHETHER OR NOT CASCADENCE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
12. Indemnification
You agree to indemnify, defend, and hold harmless Cascadence and its directors, officers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:
- Your use of the Service
- Your violation of these Terms
- Your violation of any applicable law or regulation
- Your violation of any third-party rights
- Any data or content you provide to the Service
13. Termination
We may suspend or terminate your access to the Service at any time, for any reason, without prior notice or liability. You may stop using the Service at any time.
Upon termination, your right to use the Service ceases immediately. Sections 6, 8, 10, 11, 12, 14, and 15 survive termination.
14. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
15. General Provisions
- Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Cascadence regarding the Service.
- Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force and effect.
- Waiver. Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
- Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
- Modifications. We may modify these Terms at any time. Material changes will be communicated via email or notice on the Service. Continued use after changes constitutes acceptance.
